Aspergers Hacker Sentenced

A hacker who compromised a US Department of Transportation website in order to to profit approximately 2.7 million dollars has been sentenced to 55 months in federal prison.  There are some important factors in this sentence for Gary McKinnon, another hacker with Aspergers who will most likely be extradited from the UK to the US.

Viachelav Berkovich, 34 – who has Aspergers Syndrome received  a reduced sentence 55 months in prison, which is 23 months less then the federal sentencing guidelines call for and 5 months less than that recommended by the prosecution.  The judge presiding over the case, U.S. District Judge John Walter also ordered the US Berau of Prisons to perform a mental health assessment on Berkovich once in their custody.

Berkovich’s attorney made a statement about the reduced sentence. “The court tried to make a fair sentence … and gave us some of what we asked for, and did accept that Mr. Berkovich suffered from Asperger’s But at the same time felt that this was serious and that a substantial prison sentence was called for to deter others.”

This very clearly states, despite what Gary McKinnon says the US Legal system does take into account disabilities such as Aspergers Syndrome when sentencing guilty parties.  Now will Gary McKinnon quite whining?

I do hope that Gary McKinnon supporters don’t quit, or as you spell it, quite, whining. The case should be heard in England as this is where supposedly the
crime was committed.
