While it is the goal of AspieWeb to promote thought, conversation and new ideas that would benefit people on the Autism Spectrum ZDigital Media LLC enforces its rights to its intellectual property rigorously.  Hard work is put into content provided on AspieWeb and other web properties and theft of such work is unacceptable by legal, moral and ethical standards. If you are found stealing our work we will take action.

Fair Use

Fair use of content on AspieWeb is encouraged.  The content provided is here to promote thought, conversation and new ideas that would benefit people on the Autism Spectrum.  However fair use has its limits according to title 17, U. S. Code Section 107 Subsection 3 and 4.  Fair use is limited to excerpts of the work in order to comment, criticize or parody.  Substantial or complete copies of a work are not fair use.

To comply with fair use you must only include an excerpt of the original work, an attributable to this website that includes a link to the original work.

If You Are Caught

These are the steps you will face if I catch you stealing work.

  1. DMCA Takedown Notice – This notice will be sent to you and your provider.  Its a legal way of saying take down our work or there will be penalties.  If you comply with this notice no other action will be taken.
  2. Cease And Desist Order – This notice is not so friendly and gives notice that if you do not take down the stolen work the penalties we will be seeking.  This is sent to you and your provider.  If you comply no further action will be taken.
  3. Notification of Third Parties - At this point we will begin notifying third parties of the infringement including your domain registrar, search engines (which are required by law to deindex your page), advertisers, paypal, and any other third party services used on your site or that index your site.
  4. Seeking of Damages – At this point we will also file court paperwork seeking damages as well as a court order to remove the infringing material.

Possible Damages

  • Up to $150,000 per work for willful infringment
  • Legal Fees, Court Fees and Lawyer Fees
  • Possible Criminal Charges

Most countries have similar copyright laws or treaties with the United States on copyright laws and any third party provider in areas subject to US copyright law are required to abide by it.
